Words and phrases beginning with capital letters are defined here in Article 1 of the terms and conditions of use.

Preamble

Any access and/or use of the site www.akiTalent.com requires acceptance and respect for all the terms of these Terms and their unconditional acceptance. They are therefore a contract between the Service and the User.

The User is invited to read these Terms with the utmost attention and to renew his reading at each consultation of the site.
In the event that the User does not wish to accept all or part of these terms and conditions, the User is asked to forego all use of the Service.

1. Definitions

Terms of Use: refers to these conditions to which any User of the registered or unregistered site must comply.
Site: designates the website "www.akiTalent.com"

Company: refers to the SASU AkiTalent registered in the register of trade and companies of Versailles under the number 882 666 753 R.C.S. Versailles User: generally refers to any internet user of the site, registered or not.
User Candidate: refers to the User holding an account on the Site in order to benefit from the recruitment services offered by the "akitalent.com" site.
User Recruiter: refers to the user who created his profile within the recruiting space. This space allows it, after subscription to paid services, to show job ads or internships, access the CVthèque, insert advertising inserts and create its Enterprise Page.
CVthèque: refers to the database of all CVs of Candidate Users, accessible to Recruiting Users who have subscribed to them.

 

2. Object The Site is for Candidate Users and Recruiting Users.
It allows the Candidate User to access  free of charge: - A personal account space called "candiates login" - A space to file his CV - A space for "Headhunter"

- A space listing all the job offers of the site

- A space "News and; Information, listing information and advice

- Business Recruiting Pages

- A space for Career Coaching

- a space for "Consultation"

- other tools and services that will be published during the future development of the site


It allows any Recruiting User to  access: - A personal account space called a "recruiting space" for free


The Recruiter User may purchase one of the following paid services offered on the Site: ' Publication of ads ' Access to the CV Library ' Creation of an Enterprise Page ' Highlighting or Inserting advertising inserts In the event that the Recruiter User buys one of the paid services of the Site, In addition to the General Terms of Use, it must comply with the "General Terms of Sale" that it has accepted prior to its purchase.


General Terms of Use and Legal Mentions are accessible through links at the foot of each page of the Site.
The Site carries out a prior check on job advertisements and the legality of the information provided. However, if a User feels that an ad is breaking the law, they agree to report it to the Site that will take the necessary action.

3. Access to the Site


The Site is accessible free of charge to any User with an internet connection. All costs associated with connecting to the Site are fully borne by the User.
At the time of registration, the User chooses an identifier and password that are personal and confidential. The User undertakes to maintain their confidentiality and to assume the consequences that would result from their voluntary disclosure or not. The Site disclaims any responsibility for the user's voluntary or involuntary transmission to a third party of his password and access codes.
The Company uses all reasonable means to ensure quality access to the Site. However, the Company is not required to do so.
Access to the Site may be suspended temporarily without notice without this interruption entitling the User to any obligation or compensation.

 


4. Intellectual property


All content that makes up the Site is protected by intellectual property rights. Protected items include: Recruiter Users' trademarks, photographs, drawings, videograms and logos.
Accordingly, any reproduction, representation, use, adaptation, modification, incorporation, translation, marketing, partial or integral by any process and on any medium of the content of the Site are prohibited subject to the exceptions covered by Article L.122.5 of the Intellectual Property Code, or risk constituting a crime of infringement punishable by civil and criminal prosecution.
The company does not acquire any ownership of the content provided by the Users. Users are the only holders of intellectual property rights to the works of the mind (images, videograms, texts, logos..) that they publish on the Site. By posting them on the Site, Users agree that the Company can change their display to the public.


5. Company responsibility


Society cannot be equated with an employer. The sole purpose of the Site is to connect Candidate Users with Recruiting Users and thus facilitate the search for jobs and candidates.
The User is the sole master of the proper use of the information present on the site. The site cannot guarantee the accuracy or relevance of the data.
The Company's liability cannot be sought in the event of the relationship between users and the Site's advertisers/partners.
The Company's liability cannot be sought for technical problems encountered on the Site.
The existence of a link from this Site to another site does not constitute a validation of this site or its content on the part of the Company.
The Company cannot be held responsible for any problems encountered on all other sites and/or blogs to which links are made, or for any other information published on these sites and/or blogs, as well as for the consequences of their use.

 


6. User responsibility and obligations


The User must comply with these General Terms of Use that condition access to the site. Users who do not comply with these conditions may be denied access to the Site without prior notification by the Company.
The User is solely responsible for any use of the site, its data made by itself for or by a third party from its account.
The use of the Site, its services, its databases is only allowed for professional purposes.
As a result, the User prohibits itself from:

- publishing on the Site information of a defamatory, insulting, derogatory, obscene, pornographic, child pornography, violent or inciting violence, character, racist, xenophobic, discriminatory;
Create a Candidate or User Recruiter account using the identity of a third party or a non-existent identity;
Publish false, advertising or promotional CVs;
Publish false, advertising or promotional advertisements;
Diverting or attempting to divert any of the Site's features from its normal use;
Endangering the security of the Site and its technical components by any means;
Extract, duplicate, copy data, job offers or content on the Site without the Company's express and written permission;
Infringing on the privacy and security of personal data about users of the Site;
Use the Site to send massive unsolicited messages (advertising or other);
Collect information about users or third parties, including email addresses, for use in sending commercial or equivalent solicitations, or to integrate it into a free or paid referencing or equivalent service;
Decompiling the site's codes, programs and web pages;
To exploit data present on the Site, especially through computer robots.

In the event that a User commits any of the previously listed facts, the Company reserves the right to block access to all or part of the Site's services, temporarily or permanently, without any consideration and, if the User is registered on the Site, to unilaterally suspend and/or terminate its registration.


7. Personal data


The Company undertakes to comply with the provisions of the "Computer and Freedoms" Act of January 6, 1978 amended by the law of August 6, 2004 regarding personal information that the User communicates in connection with the use of the Site.
The personal data collected on the Site is reported to the CNIL under the following registration number: no.1971228v0

This data is processed and is intended to allow the User to create a candidate space or a recruiting space so that he can take advantage of the services offered by the Site. The data collected is also used for anonymous consultation statistics.
When creating its profile, the Candidate User has the option to refuse to see his CV, and the personal data that composes it, to appear in the CV library and be the subject of a communication to The Recruiting Users. To do so, he must inform the Society.
The User agrees to be fully and personally responsible for the content of any document published on the Site and all the consequences resulting from that publication.
Users are also informed that the data they have provided at the time of registration can be used to provide them with the Site newsletter, i.e. job offers and relevant information relevant to their profile.
The User has the right to access, correct and object to his information. At any time, he can also request the deletion of his account. In order to exercise these rights, the User will have to justify his identity and proceed with his request via the following address contact@akiTalent.com.

8. Cookies


Within the User's computer, traffic data and cookie files are implanted to conduct internal traffic analyses of the Site's information pages to improve content and establish statistical data (pages viewed, consultation hours, etc.).
The User has in his navigation software the possibility to object to the registration of cookies in his computer (function "private navigation").

9. Applicable law


Any dispute related to the use of the Site or the execution, interpretation or validity of these General Terms of Use is subject to French law and French courts.
In the event of a dispute that could not be reached for an amicable agreement, only the French courts under the jurisdiction of the Paris Court of Appeal have jurisdiction.
